Candle- Making Waiver

Release/Waiver– I hereby agree to indemnify and hold harmless Candleporium Fragrance House, LLC, and its officers, employees, contractors, or agents from any liability against all existing and future claims for personal injuries or damages arising from participation in any candle-making experience, activation classes, or private events. This includes financial responsibility for injuries incurred (by me and/or participating minors) both on and off-premises of Candleporium Fragrance House, regardless of whether injuries are caused by negligence.

Alcohol Assumption of Risks: I understand that alcohol may be available and consumed during the candle-making experience and other activations. I acknowledge that the consumption of alcohol can impair judgment and coordination, leading to accidents and injuries. I acknowledge that I am of legal drinking age and voluntarily assume all risks associated with alcohol consumption during any event on and off the premises of Candleporium Fragrance House. I agree to drink responsibly and in moderation, and I will not operate any machinery or handle any hot wax if impaired. I affirm that I have or will plan for safe transportation should I be in no condition to drive. I hereby knowingly assume full and sole responsibility for all the foregoing risks and acknowledge that my participation in the candle-making experience and/or activations is fully voluntary. Candleporium Fragrance House reserves the right to request identification from any participant on the premises at any time.

Policies & Procedures: I understand that Candleporium Fragrance House has established specific guidelines and practices related to the candle-making experience or related activations. This may include the authority to prevent intoxicated individuals from entering the premises or participating in the experience. I commit to complying with all these guidelines and understand that, should I breach them, I may be required to exit the premises without the possibility of a refund for any fees or expenses associated with the experience.

Photo/Video Consent: In consideration of my participation in the candle-making experience and activations, I hereby grant permission to Candleporium Fragrance House and its authorized representatives to use photos, videos, and other media taken during the candle-making experience of my image, voice, and participation during the event for promotional and marketing purposes related to Candleporium Fragrance House including but not limited to websites, social media, and printed material. I understand that I will not receive any compensation for the use of these materials.

Minor Consent: I hereby give permission for images of the minor captured during the candle-making experience and activations. I hereby grant permission to Candleporium Fragrance House and its authorized representatives to use photos, videos, and other media taken during the candle-making experience of the minor’s image, voice, and participation during the event for promotional and marketing purposes related to Candleporium Fragrance House including but not limited to websites, social media, and printed material. I understand that I will not receive any compensation for the use of these materials. I understand that children under 10 are not allowed in the candle-making experience areas and must be accompanied by an adult of 18 years or older. I understand that all participants under 18 must have a parent or guardian sign a waiver on their behalf.

Medical Attention: I hereby acknowledge if an allergic reaction or skin irritation occurs (by myself and/or participating minor) from the fragrance oils and/or materials exposed during or after the candle-making experience, I hold harmless and release any and all liability from Candleporium Fragrance House, as well as any owners or employees of Candleporium Fragrance House for any condition or result that may arise as a consequence of medical attention being required.

Hazard Acknowledgement: In recognition of the potential hazards associated with the use of hot wax and equipment, including but not limited to metal wax melters, glue guns, and pouring pots, which may reach temperatures as high as 200 degrees Fahrenheit, it is the responsibility of each participant to exercise due caution for oneself and any accompanying minors. Candleporium Fragrance House and its employees bear no responsibility for any personal injuries or damage incurred on or around the event premises or during participation in activities facilitated by Candleporium Fragrance House and its staff. While every effort is made to maintain a secure environment during the event and candle-making experience, it is the collective responsibility of all participants to prioritize safety.

Chargeback: I hereby acknowledge that I have received a product/service from Candleporium Fragrance House, and I am fully satisfied with the product/service received. I understand that I have the right to dispute a transaction with my financial institution, but I willingly waive that right and agree not to initiate a chargeback or dispute for this transaction. I understand that by signing this waiver, I am releasing Candleporium Fragrance House from any liability or obligation associated with this transaction, and I agree that I will not request a chargeback or dispute through my credit card issuer or financial institution for the amount paid. This waiver is binding and constitutes a final resolution regarding the transaction mentioned above. I acknowledge that Candleporium Fragrance House has fulfilled its obligation and I have no further claims or disputes related to this transaction. If you charge back a credit/debit card charge for a payment initiated by you or any authorized user of the credit or debit card, you agree that the company may recover the amount of the chargeback in addition to fees by any means deemed necessary, including, but not limited to, recharging your credit/debit card or having the amount recovered by a collection agency.

Returns & Exchanges: In recognition of the unique and customization of the candle-making experience provided by Candleporium Fragrance House, I, the undersigned participant, hereby acknowledge that the candles produced during the candle-making class or activations are custom-made and unique to my own creative choices. I understand that due to the personalized nature of the products created during the class, returns and exchanges are not possible, and the candles cannot be resold. I am aware that all sales are final and non-refundable for the experiences. I agree to these terms and acknowledge that I will not request a return, exchange, or refund for any products created during the candle-making experience or activations. I am satisfied with the opportunity to create a custom handmade candle and accept the finality of my purchase.

I acknowledge and fully comprehend that the candle-making experience and/or event activations offered by Candleporium Fragrance House may inherently entail various risks, dangers, and hazards that can potentially lead to injury or illness. I hereby agree to release, waive, discharge, hold harmless, defend and indemnify Candleporium Fragrance House, its management, employees, and members from any and all claims, actions, or losses relating to bodily injury, property damage, wrongful death, or any other related liabilities that may arise as a result of my voluntary participation or the participation of a minor under my supervision in the candle-making experience and related activations, the produced items from the classes, or the utilization of the equipment provided by Candleporium Fragrance House. I willingly assume full responsibility for the products and the experience.

Participants will be asked to sign this waiver upon arrival.
